By accessing, browsing, registering for, or using the Kashmeeraa website, mobile application, or any related services, features, tools, or functionalities (collectively referred to as the “Platform”), you acknowledge and agree that you have read, understood, and accepted these Terms. Your use of the Platform constitutes a legally binding agreement between you and Kashmeeraa. These Terms apply to all individuals and entities who access the Platform, including viewers, registered users, creators, reviewers, brands, businesses, and visitors. In addition to these Terms, your use of the Platform is also governed by our Privacy Policy and Community Guidelines, which explain how we collect and use information and how users are expected to behave within the community.

These Terms are intended to provide a clear framework that ensures the Platform operates in a safe, transparent, and fair manner for everyone involved. They outline the responsibilities of users, the standards for acceptable content and behavior, and the rights Kashmeeraa retains in managing and maintaining the Platform. 1 Acceptance of Terms
By accessing, registering for, or using the Kashmeeraa platform, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, along with our Privacy Policy and Community Guidelines. If you do not agree to these Terms, you must not access or use the platform.
Agreement to Terms & Conditions
Your use of Kashmeeraa constitutes your acceptance of these Terms & Conditions in full. These Terms apply to all users, including viewers, creators, brands, and businesses. You agree to comply with all applicable laws and platform policies while using Kashmeeraa.
Binding Legal Agreement
These Terms & Conditions form a legally binding agreement between you and Kashmeeraa. By using the platform, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract. Failure to comply with these Terms may result in suspension, termination, or legal action, as permitted by law.

· “Platform” means the Kashmeeraa website, mobile applications, software, features, tools, and all related services operated by Kashmeeraa.
· “Services” refers to all functionalities and offerings provided through the platform, including video-based product discovery, sample requests, video reviews, social interactions, and related features.
· “Content” means any information, material, or data available on the platform, including videos, images, audio, text, reviews, comments, ratings, messages, and other materials.
· “User-Generated Content” means any Content created, uploaded, posted, or shared by a User.
·  “Account” refers to a registered user profile created to access certain features of the platform.
· “Brand” refers to any business, seller, merchant, or organization that lists, promotes, or provides products or services through Kashmeeraa.
·  “Third Party” means any person or entity other than Kashmeeraa or the User.
· “Terms” refers to these Terms & Conditions, together with the Privacy Policy, Community Guidelines, and any other policies incorporated by reference.

 

3 About the Platform
Kashmeeraa is an 18+ video-based product discovery and shopping platform that connects users, creators, and brands through authentic, user-generated video content. The platform enables users to explore products, request samples, share honest video reviews, and engage with a community built on transparency and real-world experiences. Kashmeeraa focuses on helping users make informed purchasing decisions by showcasing products through genuine usage rather than traditional advertising alone.
Nature and Scope of Services
Kashmeeraa combines video content, social interaction, and shopping-related features in one integrated platform. Services may include browsing and uploading videos, posting reviews and ratings, requesting or reviewing products, interacting with other users and brands, participating in promotional campaigns, and accessing related tools or features. Kashmeeraa acts solely as a technology platform for discovery and engagement and does not manufacture, sell, or guarantee third-party products or services featured on the platform.
Platform Availability
Kashmeeraa strives to provide reliable access to the platform, however, availability is not guaranteed. The platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. Kashmeeraa reserves the right to modify, suspend, or discontinue any part of the platform or services at any time, with or without notice, to the extent permitted by law.

 

4 Eligibility & Age Requirements
The Kashmeeraa Platform is intended only for individuals who are 18 years of age or older. Persons under 18 are not permitted to create accounts or use the Platform independently. Kashmeeraa does not knowingly collect personal information from children under 18, in accordance with the Children’s Online Privacy Protection Act (COPPA) and other applicable laws. If we discover that information from a minor has been collected without proper authorization, we may remove the information and terminate the related account.
A parent or legal guardian with a valid Kashmeeraa account may upload images or videos that include their child. By uploading such content, the user represents and confirms that they have full parental authority and consent to share the content and allow the minor to appear on the Platform.
The parent or legal guardian is fully responsible for any content involving minors, including ensuring the content is lawful, appropriate, and compliant with all applicable laws and Kashmeeraa policies. Kashmeeraa does not independently verify parental consent.
Unauthorized uploading of content involving minors is strictly prohibited. Kashmeeraa reserves the right to review, restrict, or remove any content involving minors that is unsafe, inappropriate, or violates our policies or applicable laws.
Users should avoid sharing sensitive personal information about minors, such as identifying details, locations, or private data. By uploading content involving minors, you acknowledge that you are solely responsible for obtaining proper permissions and for the content you share.

 

5 Account Registration & Security
Account Creation
To access certain features of Kashmeeraa, you must create an account by providing the required registration information and agreeing to these Terms & Conditions, the Privacy Policy, and the Community Guidelines. Account registration is available only to eligible users who meet the platform’s age and eligibility requirements. Kashmeeraa reserves the right to approve, reject, suspend, or terminate any account at its discretion, in accordance with applicable law.
Accuracy of Information
You agree to provide accurate, current, and complete information during account registration and at all times while using the platform. You are responsible for keeping your account information up to date. Providing false, misleading, or incomplete information may result in suspension or termination of your account.
Account Credentials & Security
You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You must use reasonable security measures, such as creating a strong password and not sharing your login details with others. Kashmeeraa is not responsible for any loss or damage arising from unauthorized access caused by your failure to protect your credentials.
Responsibility for Account Activity
You are solely responsible for all activities that occur under your account, whether authorized by you or not. If you suspect any unauthorized use, security breach, or compromise of your account, you must notify Kashmeeraa immediately. We reserve the right to take appropriate action, including suspending or securing your account, to protect the platform and its users.

6 User Responsibilities & Acceptable Use
Lawful Use of the Platform
You agree to use Kashmeeraa only for lawful purposes and in accordance with these Terms & Conditions. Your use of the platform must comply with all applicable local, national, and international laws and regulations, including those related to content creation, advertising, intellectual property, privacy, and consumer protection.
Prohibited Activities
You must not engage in any activity that harms Kashmeeraa, other users, or third parties. Prohibited activities include, but are not limited to:
· Uploading or sharing illegal, harmful, misleading, defamatory, obscene, or abusive content
·  Engaging in harassment, hate speech, threats, or bullying
·  Impersonating another person, brand, or entity
·  Infringing intellectual property or privacy rights
·  Attempting unauthorized access to accounts or systems
·  Using bots, scraping tools, or automation without permission
·  Manipulating reviews, engagement, or platform features
·  Conducting fraud, scams, or deceptive practices
Compliance with Community Guidelines
You agree to comply with Kashmeeraa’s Community Guidelines at all times. The Community Guidelines are incorporated into these Terms & Conditions by reference and form a binding part of this agreement. Violations of the Community Guidelines may result in content removal, account suspension, or termination, in addition to any other remedies available to Kashmeeraa. Failure to comply with this section may result in immediate enforcement action.

 

7 User-Generated Content
Ownership of User Content
You retain ownership of any content you create, upload, post, or share on Kashmeeraa, including videos, images, audio, text, reviews, comments, and other materials (“User-Generated Content”). Posting content on the platform does not transfer ownership of your content to Kashmeeraa.
License Granted to Kashmeeraa
By submitting User-Generated Content to Kashmeeraa, you grant Kashmeeraa a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such content for the purpose of operating, improving, promoting, and providing the platform and its services, in any media formats and distribution channels now known or later developed.
Content Visibility & Sharing
User-Generated Content may be public or private depending on the platform features and your settings. Public content may be viewed, shared, recommended, or featured within the platform or across Kashmeeraa services. You acknowledge that once content is made public, Kashmeeraa cannot control how third parties may use or share it.
Responsibility for Uploaded Content
You are solely responsible for the User-Generated Content you upload or share. You represent and warrant that you have all necessary rights, permissions, and authority to post such content and that it does not violate any laws, intellectual property rights, privacy rights, or Kashmeeraa policies. Kashmeeraa reserves the right to remove or restrict content that violates these Terms or applicable laws.

 

8 Content Moderation & Enforcement
Right to Review, Monitor & Remove Content
Kashmeeraa reserves the right, to review, monitor, screen, and evaluate user activity and content on the platform at any time. This may be done using automated tools or human review to ensure compliance with these Terms & Conditions, the Community Guidelines, and applicable laws. Kashmeeraa may remove, restrict, disable access to, or limit the visibility of any content that violates our policies or poses a risk to users or the platform, with or without prior notice.
Warnings, Strikes & Enforcement Actions
Depending on the nature and severity of a violation, Kashmeeraa may issue warnings, apply strikes, temporarily restrict features, reduce content visibility, or take other appropriate enforcement actions. Repeated or serious violations may result in escalated consequences, including account suspension or termination. Enforcement decisions are made at Kashmeeraa’s discretion.
Account Suspension or Termination
Kashmeeraa reserves the right to suspend, restrict, or permanently terminate your account if you violate these Terms & Conditions, the Community Guidelines, or applicable laws, or if your conduct poses legal, security, or reputational risks. Account suspension or termination may occur with or without notice. Upon termination, your access to the platform will cease, and certain content or data may be removed or retained in accordance with legal obligations. All enforcement actions are carried out in accordance with applicable laws and platform policies.

9 Community Guidelines
Incorporation by Reference
The Kashmeeraa Community Guidelines are hereby incorporated into these Terms & Conditions by reference and form a binding part of this agreement. By accessing or using the platform, you agree to comply with the Community Guidelines, as they may be updated from time to time.
Violations & Consequences
Failure to comply with the Community Guidelines may result in enforcement actions, depending on the nature and severity of the violation. Such actions may include content removal, warnings, strikes, temporary restrictions, account suspension, or permanent termination. Serious or repeated violations may result in immediate termination without prior notice. Kashmeeraa reserves the right to take any action it deems necessary to protect users, maintain platform integrity, and comply with applicable laws.

10 Intellectual Property Rights
Platform Content Ownership
All intellectual property rights in and to the Kashmeeraa platform, including but not limited to the software, source code, algorithms, design, layout, features, functionality, databases, text, graphics, icons, audio, video, and other platform materials (excluding User-Generated Content), are owned by or licensed to Kashmeeraa. These materials are protected by copyright, trademark, and other applicable intellectual property laws.
Trademarks, Logos & Branding
“Kashmeeraa,” its name, logo, trademarks, service marks, slogans, and all related branding elements are the exclusive property of Kashmeeraa. You may not use, copy, reproduce, modify, distribute, or display any Kashmeeraa trademarks or branding without prior written permission, except as expressly permitted under these Terms & Conditions or applicable law.
Restrictions on Use
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Kashmeeraa platform for personal and lawful purposes only. You may not copy, reverse engineer, decompile, modify, create derivative works from, sell, license, distribute, or otherwise exploit any part of the platform or its intellectual property without express written authorization from Kashmeeraa. Any unauthorized use may result in termination of access and legal action.All rights not expressly granted to you are reserved by Kashmeeraa.

11 Shopping, Product Requests & Reviews
User Product Requests
Kashmeeraa allows users to request products or product samples from brands for the purpose of review and discovery. Submission of a product request does not guarantee approval, fulfillment, or delivery. Brands retain full discretion over whether to accept, reject, or fulfill product requests.
Review & Recommendation Disclaimer
All reviews, ratings, recommendations, and opinions shared on Kashmeeraa are provided by users based on their personal experiences. Such content is for informational and discovery purposes only and should not be considered professional, commercial, or guaranteed advice. Kashmeeraa does not endorse, verify, or guarantee the accuracy or reliability of user reviews or recommendations.
No Guarantee of Product Quality or Availability
Products featured or reviewed on Kashmeeraa are provided by third-party brands or sellers. Kashmeeraa makes no representations or warranties regarding product quality, safety, legality, pricing, availability, or fitness for a particular purpose. Product availability, specifications, and fulfillment are determined solely by the brand or seller, and any reliance on product information is at your own risk.

 

12 Payments, Fees & Transactions
Third-Party Payment Providers
Payments and transactions on Kashmeeraa, where applicable, are processed through third-party payment service providers. Kashmeeraa does not store or process full payment card details and is not responsible for the security, performance, or actions of third-party payment providers. Your use of such services is subject to the provider’s own terms, conditions, and privacy policies.
Pricing, Taxes & Fees
All prices, fees, and charges displayed on the platform are subject to change at any time. Prices may be shown inclusive or exclusive of applicable taxes, duties, or charges, depending on your location and the nature of the transaction. You are responsible for any applicable taxes, fees, or charges imposed by government authorities or payment providers in connection with your transactions.
Refunds, Chargebacks & Disputes
Refunds, returns, chargebacks, and payment disputes are governed by the policies of the relevant brand, seller, or third-party payment provider. Kashmeeraa is not a party to transactions between users and third-party sellers and does not guarantee refunds. However, Kashmeeraa may assist in facilitating communication or resolving disputes where appropriate, without assuming liability. Users are encouraged to review applicable refund and dispute policies before completing any transaction.

13 Creator, Influencer & Sponsored Content
Creator Responsibilities
Creators, influencers, and reviewers are responsible for ensuring that all content they create and share on Kashmeeraa is honest, accurate, original, and compliant with these Terms & Conditions, the Community Guidelines, and applicable laws. Creators must respect intellectual property rights, privacy rights, and advertising standards, and must not mislead users through false claims or deceptive practices.
Disclosure of Paid or Sponsored Content
Any content that is sponsored, paid, gifted, incentivized, or created as part of a brand collaboration must be clearly and prominently disclosed. Disclosures must be easy to understand and placed within the content itself, in accordance with applicable advertising laws and guidelines (such as FTC requirements). Failure to properly disclose sponsored relationships may result in content removal, loss of monetization privileges, or account enforcement.
Monetization (If Applicable)
If Kashmeeraa offers monetization, incentive programs, or earnings opportunities, participation may be subject to additional eligibility criteria and program-specific terms. Earnings are not guaranteed and may depend on engagement, compliance, performance, and other factors. Such advertisements may be provided by Kashmeeraa or by third-party advertisers and may be personalized or non-personalized in accordance with our Privacy Policy and applicable laws. The presence of advertisements does not imply endorsement of any advertised product or service by Kashmeeraa.
Promotions, Campaigns & Offers
From time to time, Kashmeeraa may run promotions, marketing campaigns, contests, giveaways, or special offers. Participation in these activities may be subject to additional terms, eligibility requirements, and rules, which will be communicated at the time of the promotion. 17 Termination & Suspension
Termination by the User
You may stop using Kashmeeraa at any time and may request to deactivate or delete your account through the available account settings or by contacting our support team. Upon termination by you, access to your account and platform features will end, subject to any legal or contractual obligations that require continued retention of certain information.
Termination by Kashmeeraa
Kashmeeraa reserves the right to suspend, restrict, or terminate your account or access to the platform at any time, with or without notice, if you violate these Terms & Conditions, the Community Guidelines, the Privacy Policy, or applicable laws, or if your conduct poses a risk to the platform, other users, or third parties. Kashmeeraa may also suspend or discontinue the platform or any part of its services at its discretion.
Effect of Termination
Upon termination or suspension, your right to access and use Kashmeeraa will immediately cease. Certain content, data, or information may be removed, restricted, or retained in accordance with legal requirements. Provisions of these Terms that by their nature should survive termination, including intellectual property rights, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution will continue to apply. Kashmeeraa also reserves the right to remove, archive, or retain certain user data and content where required for legal, security, or operational purposes. Termination does not affect any rights or remedies accrued prior to termination.

 

18 Disclaimer of Warranties
“As Is” & “As Available” Services
Kashmeeraa is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Kashmeeraa disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that the platform will be secure, free of defects, or available at all times.
No Guarantee of Accuracy or Availability
Kashmeeraa does not warrant the accuracy, completeness, reliability, or timeliness of any content, information, reviews, recommendations, or materials available on the platform. User-generated content and third-party materials are provided for informational purposes only and may contain errors or inaccuracies. We also do not guarantee that the platform or any features will always be available or operate without interruption. Your use of Kashmeeraa is at your own risk, and you assume full responsibility for any reliance on information or services provided through the platform.

19 Limitation of Liability
Exclusion of Certain Damages
To the fullest extent permitted by applicable law, Kashmeeraa, its affiliates, directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes, without limitation, damages for loss of profits, revenue, data, business opportunities, goodwill, or other intangible losses arising out of or related to your access to or use of, or inability to use, the platform, even if Kashmeeraa has been advised of the possibility of such damages.
Maximum Liability Limits
To the maximum extent permitted by law, Kashmeeraa’s total cumulative liability for any claims arising out of or related to these Terms & Conditions or your use of the platform shall not exceed the amount paid by you to Kashmeeraa, if any, in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater. If you have not paid any fees to Kashmeeraa, our total liability shall be limited to USD $100. Nothing in this section limits liability where such limitation is prohibited by law, including liability for fraud, willful misconduct, or gross negligence where applicable. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

20 Indemnification
User Indemnity Obligations
You agree to indemnify, defend, and hold harmless Kashmeeraa, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
· Your access to or use of the Kashmeeraa platform
· Your User-Generated Content
· Your violation of these Terms & Conditions, the Community Guidelines, or the Privacy Policy
· Your violation of any applicable law or regulation
· Your infringement or misappropriation of any intellectual property, privacy, or other rights of any third party
Kashmeeraa reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate fully in asserting any available defenses.
These indemnification obligations survive the termination or suspension of your account and use of the platform.

 

21 Copyright & Intellectual Property Infringement (DMCA)
Kashmeeraa respects intellectual property rights and expects users to do the same. You may not upload, share, or distribute any content that infringes copyrights, trademarks, or other rights of any person or entity. If you believe your intellectual property has been infringed on the Platform, you may submit a DMCA notice requesting removal of the content. A valid notice must include:

• Identification of the copyrighted work
• Identification and location of the infringing material
• Your contact information (name, address, email, phone)
• A good faith statement that the use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

Upon receiving a valid notice, Kashmeeraa may remove or disable access to the content and notify the user.

Counter-Notification
If you believe your content was removed by mistake, you may submit a counter-notification with your details, a statement under penalty of perjury, and consent to legal jurisdiction. Content may be restored unless legal action is taken.Kashmeeraa reserves the right to remove infringing content, terminate repeat offenders, and take appropriate action.

22 Governing Law & Jurisdiction
These Terms & Conditions, and any dispute, claim, or controversy arising out of or relating to the Kashmeeraa Platform, its services, or the use of the Platform, shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles. By accessing or using the Kashmeeraa Platform, you agree that any legal action, claim, or dispute arising out of or relating to these Terms & Conditions or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located within the Commonwealth of Kentucky, United States, unless otherwise required by applicable law. You further agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claims or disputes.
Nothing in this section shall limit or restrict any rights or remedies available under applicable consumer protection laws that cannot be waived by contract.

23 Dispute Resolution
Informal Resolution
Before taking legal action, you agree to first attempt to resolve any dispute with Kashmeeraa through good-faith discussions by contacting us. We will make reasonable efforts to resolve the issue promptly.

Arbitration or Court Proceedings
If the dispute is not resolved informally, it may be resolved through binding arbitration or, where not permitted by law, in the appropriate courts as outlined in the Governing Law section.

Class Action Waiver
To the extent permitted by law, all disputes must be brought individually and not as part of any class, collective, or representative action.

Nothing in this section limits any rights you may have under applicable law.

Force Majeure
Kashmeeraa is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, war, government actions, cyberattacks, or service provider failures. Obligations will resume as soon as reasonably possible after the event ends.

Severability
If any part of these Terms is found invalid or unenforceable, the rest remain in effect. Where possible, the invalid part will be replaced with a valid provision reflecting the original intent.

Assignment
You may not transfer your rights or obligations without Kashmeeraa’s written consent. Kashmeeraa may assign or transfer these Terms at any time, including during mergers or acquisitions, and they will remain binding on successors.

Entire Agreement
These Terms, together with the Privacy Policy, Community Guidelines, and other referenced policies, constitute the full agreement between you and Kashmeeraa regarding use of the platform. No prior agreements or communications override these Terms.
